Kardashian Split Raises Questions About Divorce

By now most of us have heard the news that Kim Kardashian has recently filed for divorce from husband Kris Humphries after 72 days of marriage. Critics have said that the wedding was nothing more than a sham and publicity stunt designed to raise ratings for Keeping Up with the Kardashians.

The couple's August 20th, 2011 wedding recently aired as a two part special on the E! television network, and was watched by over four million people. Advertisers paid top-dollar to air commercials during the wedding episodes, and the couple allegedly sold its wedding day photos to People magazine for over a million dollars.

When Kardashian filed for divorce on October 31st, she said her fairytale was over. Both E! and Kardashian have claimed that the marriage was real and that the couple just grew apart. But is it that easy? Is simply falling out of love with your spouse enough to get a divorce? How long do you have to be married before filing for divorce?

Each state has its own divorce laws. Georgia is a no-fault divorce state, which means that the party filing for divorce can say that the marriage is "irretrievably broken." No specific reason is necessary. If there is a reason for the divorce, such as one spouse having an affair or being physically or mentally abusive, it could impact the way that the court determines any property decision or custody disputes.

So what happens when a couple living in Georgia falls out of love fast? Georgia requires that one of the parties in the marriage needs to reside within the state for six months before filing for divorce. Even if one party has left the state, as long as one party remains in Georgia, the divorce will be allowed to proceed.

Most marriages will last a little longer than 72 days, but things can happen that make it impossible to stay together. It is difficult to determine when a marriage is really over, and this can be an extremely emotional time for all involved. Knowing what comes next can help reduce some of the problems that may arise.
