Charlie Sheen and Brooke Mueller File for Divorce

| Nov 2, 2010 | Firm News, High-Asset Divorce |

Charlie Sheen and Brooke Mueller’s relationship has come to an end as they both filed separate petitions for the dissolution of their marriage. Both Sheen and Mueller cited the same day as their date of separation and that they had irreconcilable differences. Beyond those two similarities, the documents for the high-asset divorce requested nearly opposite results.

Sheen filed for divorce with the court early Monday morning. According to the documents, Sheen is requesting joint custody of the couple’s twin boys. He claimed that he should not be ordered to pay any spousal support despite the settlement agreement the couple drew up after the misdemeanor assault incident to which Sheen eventually pled guilty. The incident occurred on December 25, 2009, the couple’s stipulated date of separation. Sheen also claims that any income he has received beyond that date should not be considered as community property.

Not surprisingly, Mueller’s petition filed only a few hours after Sheen’s requested spousal support and sole custody of the two boys but stated that she would allow substantial visitation for Sheen with the 1 ½-year old boys, Bob and Max.

The agreement reached between the couple allegedly stated that Mueller would receive $757,000 immediately and $1.2 million as a part of their home equity. The agreement also provided Mueller with $55,000 per month in child support payments. The couple allegedly agreed to joint custody of the children but that they would primarily reside with their mother.

The papers have been filed, but we will have to wait for the final ruling from the family court judge. It is unclear as of yet how Sheen’s recent media attention involving the New York hotel room or the assault conviction will play into the decision for child custody.
