Real Housewives of Atlanta, NeNe Leakes could be a Grandmother

| Jan 10, 2011 | Firm News, Visitation Rights |

Rumors have begun appearing that Real Housewives of Atlanta star, NeNe Leakes may become a grandmother in slightly less than nine months but according to the reality television star, “may” is the operative word. The famous television star was reportedly less than thrilled with the news that her son’s girlfriend was allegedly pregnant.

While the Georgia native may have serious woes about becoming a grandmother, her son, Bryson Bryant, could now face legal complications of his own because the couple is not married. Without the legal presumption of paternity that accompanies the birth of a child born through marriage, the father-to-be may have to go to court to obtain visitation rights should the couple decide to split.

According to NeNe Leakes, the issue of paternity is definitely undetermined. She has made claims of a request for a paternity test, arguing that if the child is in fact her grandson, she would be the one who would have to pay to raise the child. While that may be morally true for Leakes, the son would have the legal responsibility of paying child support. It is unclear as of yet who will be named as the father on the birth certificate.

Depending on state law, an unwed father does not automatically receive visitation rights to a child. The father must first receive legitimation of parentage through a court order before he can pursue visitation rights or custody of a child. Although criticism has been made that a father’s rights are less protected in the family court system, the claim is false, and experienced representation can ensure that a father’s rights are upheld.
